On 14 February 2025, the land and Environment Court gave judgment in Phelps and Ors v Minister Administering the Water Management Act 2000 [2025] NSWLEC 4, dismissing a challenge by various landholders to a decision of the Minister concerning the allocation of water under supplementary water access licences. The landholders argued that the decision was not authorised under the applicable water sharing plan. There was also an allegation of bias. The Court rejected all the claims made by the landholders (many of which raised complex issues concerning hydrologic computer models) and concluded that the decision of the Minister should be upheld. Henry El-Hage SC, together with Matthias Thompson, appeared for the Minister.
